The Situation’s Trademark Problems

Yes, Sitch, that's right. Two people are trying to trademark your name...

Just to show that we have no ill-will towards the Sitch for not showing up in our city last night (there are reports of people dejectedly wandering around downtown in their wifebeaters, sadly stroking their abs) we decided to give you all a bit of Situation news.

Perez Hilton picked this story up yesterday.

Apparently “The Situation” is in the process of being trademarked by two different people at the current moment – and neither of them is Mike “The Situation” Sorrentino.

The first application filed with the U.S. Patent and Trademark Office is to place the words “The Situation” on t-shirts and underwear – a la the Situation’s first day at the t-shirt shop on the boardwalk – filed by The Sitch’s brother, Marc Sorrentino, a porn company owner.

Classy? No. Surprising? Hell no.

The second was filed by the company Vadio LLC to use the phrase on tracksuits and swimsuits.

With the Situation’s upcoming cologne – Sitch by The Situation – you’d think our Sitch would have to figure out these trademark issues soon. Now we’re not patent or trademark law scholars in any way, shape or form, but it seems that you could play the debut episode of Jersey Shore (which aired Dec. 3 and was filmed in August 2009) for the trademark officer to prove that the Situation was using the name well before Vadio LLC applied for the trademark on Dec. 11 or the Sitch’s own brother on Dec. 28.

Let’s hope Mike gets it figured out soon!
